1. Scope of Application
These terms and conditions apply to all users of the Cuevie application ("the Service"). By using the Service, you agree to be bound by these terms. If you do not agree to these terms, you may not use the Service.
2. Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement. If we become aware that a user is under 16, we reserve the right to suspend or terminate the associated account.
3. Service Description
Cuevie provides a platform for users to create lobbies, invite friends, and collectively decide on movies to watch. The Service uses The Movie Database (TMDb) API for movie data but is not endorsed or certified by TMDb.
4. User Accounts
Users can sign in anonymously or via a Google account. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
5. User Conduct
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. Prohibited behavior includes, but is not limited to, harassment of other users and submission of malicious content.
6. User-Generated Content
You retain ownership of any content you submit to the Service, such as lists, comments, and lobby messages ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content as necessary to operate and provide the Service. You are solely responsible for your User Content, and we are not responsible for content posted by users.
7. Intellectual Property
The Service and its original content (excluding data from TMDb and User Content), features, and functionality are and will remain the exclusive property of Cuevie and its licensors. Our trademarks may not be used in connection with any product or service without our prior written consent.
8. Kernels & Virtual Currency
Kernels are a virtual, in-app currency earned by completing quests within the Service. Kernels have no monetary value, cannot be exchanged or redeemed for real currency, and are not transferable between accounts. We reserve the right to adjust how Kernels are earned or spent, change shop prices, or reset or revoke Kernel balances at any time, including to address bugs or exploits. Kernel packs may be made available for purchase with real money in the future; any such purchases will be subject to additional terms, including pricing and refund conditions, presented at the time of purchase.
9. Account Termination
We reserve the right to suspend or terminate your account, with or without notice, if we believe you have violated these Terms or engaged in conduct that harms the Service or other users. You may stop using the Service and request deletion of your account at any time.
10. Service Availability
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including uninterrupted availability. We do not guarantee that the Service will be available at all times or free of errors, bugs, or downtime.
11. Limitation of Liability
In no event shall Cuevie, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms and Conditions on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.
